1. Current charges for web hosting services are set forth on the Gondola Webworks website at http://gwebworks.com/hosting.shtml.

2. Registration of a domain name is not the responsibility of Gondola Webworks. Gondola Webworks may however assist a Client in having their domain name registered. Any charges for such registration will be passed straight on to the Client.

3. Payment for web hosting will be in advance, in blocks of 3 months or multiples thereof. Should any Client's web hosting account become in arrears, Gondola Webworks reserves the right to remove the website at any time after the payment date is passed. When the defaulting account has been paid, the website will be immediately restored.

4. Invoices for web hosting renewals will be sent by email one month in advance of the due date.

5. A surcharge equal to one month's hosting fee will be levied in order to reinstate a suspended website.

6. In the unlikely event that Gondola Webworks is unable to host any website it is contracted to host, Gondola Webworks will refund 100% of all of the remaining web hosting fees to the Client. Gondola Webworks undertakes to give the Client at least one month's prior notice.

7. Should the Client opt to terminate the web hosting agreement, the Client is to give Gondola Webworks one month's prior notice. At the expiration of that notice period, 50% of the unused fees will be refunded.

8. Should a redirection page be required, then it can be hosted at 50% of the monthly rate, paid in advance. This fee is non-refundable.

9. Any fee increases for web hosting will be effected only after the current paid up time is completed. Also Gondola Webworks will give one month's notice prior to such increase(s).

B. Disclaimer

The materials in any website produced by Gondola Webworks are provided "as is" and without warranties of any kind either express or implied.

To the fullest extent permissible pursuant to applicable law, Gondola Webworks disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

Gondola Webworks do not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that the servers hosting websites in the Gondola Webworks are free of viruses or other harmful components.

Gondola Webworks do not warrant or make any representations regarding the use or the results of the use of the materials in any website produced by Gondola Webworks, in terms of their correctness, accuracy, reliability, or otherwise. The Client (and not Gondola Webworks) assumes the entire cost of all necessary servicing, repair or correction, unless it can be clearly determined that the errors and/or omissions are the fault of Gondola Webworks at the time of product creation, where instructions were clearly given by the Client and said instructions were not followed.

C. Limitation of Liability

Under no circumstances including, but not limited to, negligence, shall Gondola Webworks be liable for any special or consequential damages or loss of earnings that result from the use of, or the inability to use, any website produced or hosted by Gondola Webworks, even if Gondola Webworks or its authorized representative(s) have been advised of the possibility of such damages.
